Terms of Service

Hot Key Media LLC, a Florida limited liability company (“Hot Key Media LLC,” “we,” or “us”), owns and operates MedicalBillingPath.com (the “Site”), which provides at no charge to you (“user” or “you”) informational resources about medical billing and coding training, certifications, careers, and schools, and, in some cases, access to school inquiry forms and program listings created and posted by various schools or lead-generation partners (“Listings”).

Hot Key Media LLC has no ownership of, affiliation with, or control over the schools or partners that produce these Listings, nor their admissions policies, practices, or enrollment availability. We make no promises or warranties whatsoever regarding: (a) the Listings themselves; (b) the schools or partners that created the Listings; (c) the content or accuracy of the Listings; (d) the policies or practices of the schools that may review completed inquiries you submit; or (e) whether there are any current openings or enrollment opportunities at these schools.

The Site uses school listing widgets provided by ESY (esyoh.com) and may use other lead-generation partners to display program information and connect visitors with schools. These third-party services may collect information you provide and are governed by their own terms and privacy policies.

1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a binding agreement between you and Hot Key Media LLC and are deemed accepted by you each time you use or access the Site or its services (“Services”). If you do not accept these Terms: (a) do not use the Site; (b) do not use the Services; and (c) do not submit any information or inquiries through the Site. The “Services” include, without limitation, all websites under Hot Key Media LLC’s control, including MedicalBillingPath.com, and any online service providing access to Listings, informational content, or related resources.

2. Nature of the Services

Hot Key Media LLC provides only the facilities for accessing Listings and related informational resources. We do not approve, endorse, or verify any Listing, school, certifying body, or user of the Services, and we do not review the background of any school or individual user. We are not a school and do not enroll students.

3. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, to submit information through the Site. By using the Services you represent that you meet this requirement.

4. Content Responsibility

All information, data, text, software, graphics, links, or other materials available through the Services (“Content”) are the sole responsibility of the entity from whom such Content originated. You, and not Hot Key Media LLC, are entirely responsible for all Content you download, transmit, or use through the Services.

5. No Control Over Third-Party Content

Listings, school websites, certifying body materials, and other third-party content are outside our control. We do not guarantee their accuracy, completeness, or availability, and your dealings with third parties are solely between you and them.

6. Prohibited Uses

You agree not to use the Services to: (a) distribute unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable Content; (b) share Content you do not have the right to make available; (c) infringe any patent, trademark, copyright, trade secret, or other proprietary right; (d) send unsolicited advertising, spam, or other solicitation; (e) upload viruses, malware, or harmful code; (f) scrape or crawl the Site at a rate that degrades it or in violation of our robots directives; (g) misrepresent your identity in any form; or (h) violate any local, state, national, or international law.

7. User Contributions

If you submit messages, corrections, or other material to us (“User Contributions”), you grant Hot Key Media LLC a non-exclusive, royalty-free, perpetual license to use, reproduce, and publish that material for the purpose of operating and improving the Site. You represent that you have the right to grant this license.

8. Monitoring and Removal

Hot Key Media LLC may, but is not obligated to, pre-screen, review, or remove any Content or User Contribution at our sole discretion.

9. Indemnification

You agree to indemnify and hold harmless Hot Key Media LLC, its owners, affiliates, employees, and agents from any claim or demand, including reasonable attorneys’ fees, arising from your use of the Services, your User Contributions, your violation of these Terms, or your violation of any rights of another.

10. Termination

We may, in our sole discretion and without prior notice, immediately terminate your access to the Services. We shall not be liable for any consequences resulting from termination.

11. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION, INCLUDING WAGE, EMPLOYMENT, TUITION, OR CERTIFICATION INFORMATION, IS ACCURATE, COMPLETE, OR CURRENT. WAGE AND OUTLOOK FIGURES ARE GOVERNMENT STATISTICS FOR GROUPS OF WORKERS AND DO NOT PREDICT ANY INDIVIDUAL’S EARNINGS, EMPLOYMENT, CERTIFICATION, OR ADMISSION.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOT KEY MEDIA LLC SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM: (i) your use of or inability to use the Services; (ii) the cost of substitute goods or services; (iii) unauthorized access to or alteration of your data; (iv) statements or conduct of third parties using the Services; or (v) any other matter relating to the Services.

13. Exclusions and Limitations

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

14. Intellectual Property and Copyright Policy

Hot Key Media LLC respects the intellectual property of others. We have no responsibility for content on other websites you may access through the Site. It is our policy, in appropriate circumstances, to remove infringing material and to terminate access for repeat infringers.

Notice for Claims of Infringement

If you believe your work has been copied in a way that constitutes copyright infringement, provide us with: (a) a signature of the person authorized to act on behalf of the copyright owner; (b) a description of the copyrighted work you claim has been infringed; (c) a description of where the material is located on the Site; (d) your address, phone number, and email; (e) a statement of good faith belief that the use is not authorized by the owner, its agent, or the law; and (f) a statement under penalty of perjury that the information is accurate and you are authorized to act.

15. Entire Agreement

These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and Hot Key Media LLC regarding the Services and supersede any prior agreements.

16. Governing Law

These Terms and the relationship between you and Hot Key Media LLC shall be governed by the laws of the State of Florida, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Florida.

17. Waiver and Severability

Our failure to enforce any provision of these Terms is not a waiver of that provision. If any provision is found invalid, the remaining provisions remain in full force.

18. Our Intellectual Property

You acknowledge that Hot Key Media LLC has exclusive rights to the Site, its name, logos, and service marks (“Marks”) and agree not to use them without our express written permission. Federal government data is in the public domain. Certification names, including CPC, CPB, CCA, CCS, RHIT, and CBCS, are the property of their respective organizations (AAPC, AHIMA, and NHA) and are used on the Site to describe them.

By using the Site, you acknowledge that you have read these Terms and agree to be bound by them.
